A trademark application can be examined about 2 months earlier than other regular cases, if the following conditions are all met:
(1) Filing via the e-filing system;
(2) Filing for traditional plain trademarks;
(3) All descriptions of designated goods/services are exactly the same as those listed in the e-filing system;
(4) Fee paid via online methods: paid through a designated bank account, via e-ATM, or paid by an electronic payment sheet in printout form; and
(5) A power of attorney submitted if there is a local trademark agent appointed.
A case filed through fast-track mechanism still subjects to First-to-file principle.
That is to say the firstly filed case has the right to exclude the other cases filed subsequent to it.
